Terms & Conditions

§ 1 Scope, Definitions

(1) Betrayal GbR, Fischergasse 2, 63808 Haibach, Germany (hereinafter: “we” or “Betrayal Shop”) operates an online shop for physical goods and digital products at https://shop.betrayal.eu. The following General Terms and Conditions apply to all services between us and our customers (hereinafter: “Customer” or “you”) in the version valid at the time of the order, unless otherwise expressly agreed.

(2) A “Consumer” within the meaning of these terms and conditions is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An “Entrepreneur” is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.

§ 2 Conclusion of Contract, Storage of Contract Text

(1) The following provisions on the conclusion of a contract apply to orders placed via our online shop at https://shop.betrayal.eu.

(2) Our product presentations on the internet are non-binding and do not constitute a legally binding offer to conclude a contract.

(3) Upon receipt of an order in our online shop, the following rules apply: The customer makes a binding contractual offer by successfully completing the order procedure provided in our online shop. The order is placed in the following steps:

  • Selection of the desired physical or digital goods,
  • Adding the products by clicking the corresponding button (e.g., “Add to Cart”),
  • Checking the details in the shopping cart,
  • Proceeding to the order overview by clicking the corresponding button (e.g., “Proceed to Checkout”),
  • Entering/checking address and contact details, selecting the payment method, confirming the Terms & Conditions and the Cancellation Policy,
  • Completing the order by clicking the “Buy Now” (or equivalent “Order with obligation to pay”) button. This constitutes your binding order.

The contract is concluded when we send you an order confirmation to the specified email address within three business days.

(4) In the event of a contract being concluded, the contract is made with Betrayal GbR, Fischergasse 2, 63808 Haibach, Germany.

(5) Before submitting the order, the contract data can be printed out or electronically saved using the browser’s print function. The processing of the order and the transmission of all information required in connection with the conclusion of the contract, in particular the order data, the GTC, and the cancellation policy, takes place via email after the order has been triggered by you, partly automated. We do not store the contract text after the contract has been concluded.

(6) Input errors can be corrected using the usual keyboard, mouse, and browser functions (e.g., the browser’s “back” button) before submitting the order.

(7) You must ensure that the email address you have provided is correct, that the receipt of emails is technically guaranteed, and that it is not prevented by SPAM filters.

§ 3 Subject Matter of the Contract and Essential Characteristics of the Products / Age Verification

(1) The subject matter of the contract in our online shop is:

  • The sale of physical goods (e.g., apparel, physical music media).
  • The sale of alcoholic beverages (e.g., Gin).
  • The sale of digital goods (e.g., media downloads).

The specifically offered items can be found on our product pages.

(2) The essential characteristics of the goods and digital products are set out in the item description.

(3) Age Verification for Alcoholic Beverages: By placing an order that includes alcoholic beverages (such as Gin), you confirm that you have reached the legally required minimum age. We reserve the right to verify the age of the recipient upon delivery. Delivery will only be handed over to the ordering person or an authorized person of legal age.

(4) For the sale of digital products, the restrictions apparent from the product description apply. Unless expressly agreed otherwise, the subject of the contract is only the private use of the products without the right to resale or sublicense.

§ 4 Prices, Shipping Costs, and Delivery

(1) The prices stated in the respective offers as well as the shipping costs are total prices and include all price components including all applicable taxes (VAT).

(2) The respective purchase price must be paid prior to the delivery of the product (advance payment). The payment methods available to you are shown under a correspondingly labeled button in the online shop. Unless stated otherwise for the individual payment methods, the payment claims are due for payment immediately.

(3) In addition to the stated prices, shipping costs may apply for the delivery of physical products, unless the item is marked as free of shipping costs. The shipping costs will be clearly communicated to you in the shopping cart system and on the order overview page.

(4) Unless clearly stated otherwise in the product description, all offered physical products are ready for immediate dispatch. The standard delivery time is 3-5 business days after receipt of payment.

(5) Delivery is available worldwide.

§ 5 Right of Retention, Retention of Title

(1) You can only exercise a right of retention if it concerns claims from the same contractual relationship.

(2) The goods remain our property until the purchase price has been paid in full.

§ 6 Right of Withdrawal (Cancellation Policy)

As a consumer, you have a statutory right of withdrawal. This is governed by our separate Refund and Returns Policy / Right of Withdrawal.

§ 7 Liability

(1) Subject to the following exceptions, our liability for contractual breaches of duty and for tort is limited to intent or gross negligence.

(2) We are liable without limitation for slight negligence in the event of injury to life, body, health, or in the event of a breach of a material contractual obligation. If we are in default of performance due to slight negligence, if performance has become impossible, or if we have breached a material contractual obligation, liability for property damage and financial loss attributable thereto is limited to the foreseeable damage typical for the contract. A material contractual obligation is one whose fulfillment is essential for the proper execution of the contract, the breach of which jeopardizes the achievement of the purpose of the contract, and on the observance of which you may regularly rely.

§ 8 Contract Language

The languages available for the conclusion of the contract is English.

§ 9 Warranty

(1) The warranty is governed by statutory provisions.

(2) For entrepreneurs, the warranty period for delivered goods is 12 months.

(3) As a consumer, you are requested to check the item/digital goods for completeness, obvious defects, and transport damage immediately upon fulfillment of the contract and to notify us and the carrier of any complaints as quickly as possible. Failure to do so will naturally have no effect on your statutory warranty claims.

§ 10 Final Provisions / Dispute Resolution

(1) German law applies. For consumers, this choice of law applies only to the extent that the protection granted by mandatory provisions of the law of the country of the consumer’s habitual residence is not withdrawn.

(2) The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) are expressly excluded.

(3) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the provider is the provider’s registered office.

(4) The European Commission provides a platform for online dispute resolution (OS): https://ec.europa.eu/consumers/odr/. We are not obliged nor willing to participate in dispute settlement proceedings before a consumer arbitration board.
